Terms and Conditions

I understand that the following terms and conditions apply to the services provided by Hong Kong Supreme Nursing Service and Medical Consultancy Limited (Hong Kong Supreme Nursing) Nursing staff as independent contractors:

 

I. Placement Agent

Hong Kong Supreme Nursing will introduce suitable nursing staff to clients and will charge according to the current rate: I understand that nursing staff are free to accept or decline service opportunities and Hong Kong Supreme Nursing does not guarantee successful placement of nursing staff.

 

II. Independent Contractors (Self-Employed)

a. Nursing staff provide services as independent contractors (self-employed) who are not employees of Hong Kong     

    Supreme Nursing;

b. Hong Kong Supreme Nursing undertakes reasonable background checks on each nurse/healthcare worker that it

    places to work for Clients. However, these nurses/healthcare workers are independent contractors who are solely

    responsible for the conduct and standards of service they render

c. Hong Kong Supreme Nursing will not:   (i) take any responsibility for the actions of my nursing staff, or (ii) be liable for

    any legal responsibility for the provision of services responsibility.

III. Instruction/Supervision

a. It is my responsibility to direct and supervise (or provide appropriate direction or supervision) the work of the

    caregivers who serve me.

b. In supervising the work of nursing staff, I understand that I can refer to the Code of Professional Practice for

    Independent Contractors, which states that Hong Kong Supreme Nursing understands the applicable service level of

    nursing staff when providing general services to clients as independent contractors . I understand that I should

    communicate directly with the nursing staff to give any clear instructions.

IV. Payment

I agree to pay all charges on the bill before service begins. If I fail to pay within this period, I further agree that:

(a) Hong Kong Supreme Nursing may impose on me (and I am contractually obligated to pay) an additional 5% of the
     total amount of the relevant bills and

 (b) the caregiver serving me may cease to work until I pay in full all bills owed.

 

V. Cancellation and Amendment

Hong Kong Supreme Nursing will try to accommodate the change request and incur the relevant change fee according to the notice time in the table below. Failure to make changes as required will be considered a cancellation.

 

^Changes include, but are not limited to, the following: location changes, time changes, customer-induced delays in service hours, personnel changes, and shortened service hours.

#Except for special circumstances, the service fee will not be refunded. Hong Kong Supreme Nursing reserves the right of final refund. The company reserves the right to require the customer to present the patient's death certificate for refund purposes.

VI. Bad Weather

If the nursing staff need to work when the black rainstorm warning is in effect or the typhoon signal No. 8 or above is hoisted, the company will make the following arrangements:

a. The service charge will be adjusted to twice the normal charge. The special charge arrangement is valid for:
     i. Black rainstorm warning in effect during service
     ii. Typhoon signal No. 8 or above is valid during service period

b. If the Black Rainstorm Warning or Typhoon Signal No. 8 or above is hoisted during the work period, the customer shall bear the special transportation fee of $300.

c. Cancellation of Service Arrangements:
    i. Nursing staff will provide services as usual unless otherwise instructed
    ii. To cancel the service, please at least 4 hours before the service starts, or before 8:00 pm (if the service starts before 12:00 noon on the next day) . Otherwise, no refund will be arranged.
    iii. If the nurse cancels the service due to traffic problems, the company will try its best to arrange a replacement.

VII. Termination of Agreement

I agree that I or Hong Kong Supreme Nursing may terminate the service agreement immediately without explanation by written notice to the other party, and if I am receiving an outstanding service, the date of termination of the service agreement shall be automatically postponed to the last service date, or a later date as agreed between me and Hong Kong Supreme Nursing early date.

 

VIII. Governing Law and Jurisdiction

The Service Agreement and this document are governed by and construed in accordance with the laws of Hong Kong, and both parties agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong.

IX. Language

In the event of any inconsistency or inconsistency between the Chinese and English versions of this Agreement, the English version shall prevail.

Personal Information Collection Statement

 

I agree that the personal data of Hong Kong Supreme Nursing is collected by Hong Kong Supreme Nursing and used by Hong Kong Supreme Nursing for service introduction and other related purposes, including but not limited to assessing my needs (and patients) and arranging nursing staff for me. My personal data will be stored directly in Hong Kong Supreme Nursing's database and can only be accessed by authorised staff of Hong Kong Supreme Nursing who will access my personal data in order to provide me with a suitable introduction.

 

Hong Kong Supreme Nursing may disclose my personal data, or any part thereof, to:

- (a) any caregiver who has expressed an interest in providing services to me;

- (b) Hong Kong Supreme Nursing for or in connection with any of the above purposes any contractor, agent, other
        person or group engaged for any purpose in connection with, or any third party service provider providing       
        administrative, telecommunications, computer or other services to Hong Kong Supreme Nursing;

- (c) in accordance with applicable law, Any person to whom Hong Kong Supreme Nursing is required to make
       disclosure by government or regulation; and

- (d) any other person reasonably required to make disclosure for Hong Kong Supreme Nursing to perform the above
purposes.


I understand that Hong Kong Supreme Nursing may retain my personal data until 6 months after receiving my written notice or for such period as required by law. Pursuant to the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong), I have the right to request access to and/or correction of my personal data registered with Hong Kong Supreme Nursing. Such requests must be made in writing by email to: hksupremenursing@gmail.com

 

Hong Kong Supreme Nursing reserves the right to utilize the range of services mentioned in the agreement for promotional and marketing purposes, including use on the Hong Kong Supreme Nursing website, social media and other media channels. Client also grants Hong Kong Supreme Nursing the right and license to use Client's name, logos and trademarks for such promotional and marketing activities.
